Liberty will override statutory embargo on bail under NDPS Act if trial not concluded within reasonable time: Supreme Court

Chaudhary was accused of owning a factory where a large amount of contraband was manufactured.

He was booked for offences under Section 8 read with Sections 22 and 29 of the NDPS Act.

As per the case of the prosecution, Chaudhary’s factory was responsible for manufacturing Alprazolam Powder, a contraband which was transferred by certain other individuals in large quantity from one place to the other.

When these individuals were apprehended by the police, they disclosed the factory (owned by Chaudhary) to be the hub where the said contraband was manufactured.

Both the trial court and the Madhya Pradesh High Court dismissed his bail applications.

Aggrieved, Chaudhary approached the Supreme Court for bail.

The top court allowed the application after noting his prolonged incarceration.
