A Division Bench of Justices Attau Rahman Masoodi and Suresh Kumar Gupta noted that the petitioner had not even taken the trouble to gather a copy of the notification by which the UP assembly elections were notified.
“A writ of mandamus without assailing the decision of Election Commission of India notifying the U.P. General Assembly Elections in phases, in proceduraly invalid and non-maintainable,” the Court observed while dismissing the PIL moved by one Rishi Kumar Trivedi, the State head of Akhil Bharat Hindu Maha Sabha.
