Before the High Court, counsel for the accused submitted that the said message was not sent by him but by someone else, and that he was only the group ‘admin.’ Since no case was made out against him, the proceedings were liable to be quashed, it was argued.
On the other hand, the Additional Government Advocate opposing the application said that the liability of the sender of the message and that of the ‘group admin’ is co-extensive and it cannot be said that no offence under Section 66 of the IT Act was was made out against the accused.
