The High Court was dealing with a plea filed by former Mumbai Police officer Sachin Waze challenging the sanction given for his prosecution under UAPA in relation to the Antilia bomb scare case.
The MHA had given the sanction for Waze’s prosecution in September last year for his alleged role in planting an explosives-laden car near industrialist Mukesh Ambani’s house in Mumbai, as well as in connection with the murder of auto-parts dealer Hiren Mansukh.
While it was argued by Waze’s counsel Senior Advocate Puneet Bali that the Delhi High Court the powers to deal with the case since the order was passed by the Ministry of Home Affairs that falls under its territorial jurisdiction, Additional Solicitor General (ASG) Aman Lekhi opposed the plea on the ground that the petition can only be entertained by the Bombay High Court.
