Bombay High Court Chief Justice Dipankar Datta recuses from hearing plea to fill judges’ vacancies in HC

Failure to appoint judges would amount to denial of justice to citizens, and that the time taken to fill these positions would cause delays in delivery of justice, it stated.

The plea expressed dissatisfaction with the fact that there was a large backlog of cases for years due to shortage of judges, and that many cases were not being scheduled for hearing.

According to official data from the High Court website, the case clearance rate in 2021 was 67.52 percent, implying that 32.48 percent of cases were still pending.

Therefore, the petition requested that directions be issued to the Registrar Generals of the Supreme Court and the Bombay High Court, as well as the Principal Secretary of the Central Ministry of Law and Justice and the Principal Secretary of the State Department of Law and Judiciary, to establish a permanent mechanism to fill vacancies in the Bombay High Court as soon as possible.
