The Court was dealing with a suit filed by Hindustan Times Media Limited seeking an ex-parte ad-interim injunction against the website, which is primarily and substantially engaged in publishing, hosting, communicating, news, articles, stories and columns in Hindi and Marathi languages to Indian readers and viewers.
It was argued that mark used on the defendants’ website is in a manner and style which is deceptively similar or nearly identical to that of the Hindustan Times’ mark and is therefore aimed to deceive and confuse the consumers.
