Directing out-of-turn disposal of matters would amount to controlling roster of authority: Delhi High Court

The Court was hearing a plea seeking issuance of directions to a district magistrate to expeditiously dispose of complaint made under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Counsel for the petitioner had contended that although the complaint was made in March 2022, no effective hearing had taken place.

After hearing the petitioner, the Court noted,

“While the statute may stipulate prescribed time lines for disposal of matters, it is for the authority concerned to examine and evaluate which matters are required to be accorded precedence.”

It thus disposed of the petition while directing the district magistrate to proceed with the matter without granting any unnecessary adjournments to either party, bearing in mind the fact that the complainants were 85 years old.
