Madras High Court orders interim stay on single-judge order terminating appointment of 254 assistant professors

A bench of Justices Paresh Upadhyay and Bharatha Chakravarthy said that the order of the single judge passed last week was “unsustainable” and should be kept in “abeyance till the final hearing of the appeal.”

The single-judge had held that the appointments were tainted and since it was not possible to segregate the tainted and non-tainted appointments, it was preferable to cancel all appointments.

The Trust then filed an appeal claiming that the order of the single judge had caused “grave injustice.”

The Trust argued that the order by the single-judge was passed without affording an opportunity to the concerned assistant professors to respond to the allegations made against them by some “aggrieved unselected candidates.”

It was also argued that the petitioners before the single bench had never prayed to set aside the appointments and thus the court should not have granted such relief.
