NGT dismisses Karnataka government’s plea seeking modification of order imposing ₹500 crore penalty for failure to protect Chandapura Lake

The NGT explained that the compensation fixed was for violations that have already taken place, including the violations of the direction of the Supreme Court in Parvyaran Suraksha and added that for further delay, separate liability may have to be fixed.

“The plea that the amount is to be spent in few years and therefore, no liability has accrued is patently untenable. Liability for compensation has already accrued, which is in addition to continuing financial liability for future violations for many years as proposed by the State and prosecution and other coercive measures, in terms of judgement of the Hon’ble Supreme Court and the statutory provisions under the Water (Prevention and Control of Pollution) Act, 1974, and the Environment (Protection) Act, 1986,” the Tribunal stated.
