PM Modi security breach: PIL before Delhi High Court to ensure all civil, military aid for SPG

Advocate V Govinda Ramanan, who appeared for the petitioner, told the Court that the present plea was only on the limited point of law that the SPG should have the power of superintendence in respect of the PMā€™s safety under Section 14 of the Special Protection Group Act.

The petitioner argued that it had come to his knowledge through media reports that there was a breach in the security of Prime Minister Narendra Modi during his visit to Punjab, and that he was stuck on a flyover for more than 20 minutes which put his life at risk of a terrorist attack.

ā€œAs per media reports it has also come out in the public domain that the confidential route of the Hon’ble Prime Minister was also leaked, thereby, putting him and the life of the common citizens at risk, which, inter-alia, is also violative of Article 21 of the Constitution of India. It Ā·has also been seen that the Govt. of Punjab, including the Police officials of the state, instead of coming to the aid of the Respondent No.2 i.e., Special Protection Group in terms of Section 14 Ā· of the SPG Act, 1988 were creating obstacles in the proximate security of the Hon’ble Prime Minister,ā€ the petition said.

It said that the country has already seen and experienced the consequences of such fatal lapses pointing out how two former Prime Ministers were assassinated as a consequence of such security lapses and therefore, it poses a threat to national security.
