[PMLA] Bombay High Court refuses urgent hearing against trial court order releasing accused discharged in predicate offence

Special counsel Hiten Venegaonkar, appearing for the ED, submitted that the PMLA court made the order based on the finding that it no longer had jurisdiction to extend judicial custody, as per the Supreme Court judgment.

Venegaonkar expressed his concern that the conclusion was drawn without hearing other side.

“If milady reads the order, even milady will feel that it is wrong,” he underscored.

He went on to add that some message ought to be sent to the trial court.

However, the High Court clarified that it did not want to get influenced by observations made at the interim stage, and thus, asked the counsel to argue whatever needed to be put forth before the trial court.
