Further, stating that the petitioners have been unnecessarily dragged into the present matter, the counsel argued that an application for dropping their names has been filed in the execution application. However, instead of deciding the same, the Commission has issued summons/bailable warrants against the directors.
After hearing the parties, the Court directed the Commission to decide the petitioners’ application filed on August 5 for dismissing the case or dropping the proceedings.
“In view of the aforesaid, the order dated 05.08.2022 requiring personal presence of the petitioners is hereby quashed and set aside,” the Court ordered.
