Supreme Court grants parole to accused for two days to attend sister’s wedding

A Bench of Justices Indira Banerjee and JK Maheshwari referred to Rule 3(1)(c) of the Uttar Pradesh (Suspension of Sentences of Prisoners) Rules, 2007 which empowers government to suspend the sentence of a prisoner upto a month to enable the prisoner to attend the wedding of his/ her son, daughter, brother or sister.

“We direct that the petitioner be released on interim bail/parole for a period of two days from today. The respondents may, if necessary, release him under Police escort. The petitioner shall positively surrender to the jail authorities concerned on February 12, 2022 within 5 pm,” the order said.

The Court was hearing an appeal against an order passed by the Allahabad High Court which had rejected the application for parole filed by the petitioner for attending the wedding.

The apex court granted him relief while also stating that the State authorities if necessary, can keep him under police escort during the parole period.

“Needless to mention that if the petitioner does not surrender within 5 pm on February 12, 2022 as directed, it will be open to the State to take coercive action against the petitioner to secure his custody,” the Court made it clear.
