Supreme Court issues notice to Madhya Pradesh High Court on challenge to minimum marks prescription for Civil Judge recruitment interview

Before the top court, advocate Varun Thakur, representing the petitioners, contended that the condition of minimum marks was against the position of law settled by the Supreme Court in Ramesh Kumar v High Court of Delhi.

He highlighted that Justice Shetty’s Commission Report had also recommended not having minimum marks for interviews, and that report was accepted inAll India Judges Association v Union of India in 2002.

The plea also said that the proforma required to be filled along with the application for interview, sought details about the candidate’s family members in the judiciary. This can create prejudice in the interviewer’s mind, it was contended.

It was further argued that the High Court, in exercise of its powers, cannot travel beyond the rules already framed.
