Cannot issue directions to have 50% High Court judges from district Judiciary: Supreme Court

The Supreme Court had in February opined that the norm of having one-third of High Court judges from the district judiciary (service quota) with remaining being sourced from practicing lawyers (the Bar), should be maintained and followed

The bench had requested Chief Justices of High Courts to keep the said ratio in mind while making recommendations to the Supreme Court Collegium for the appointment and transfer of High Court judges.

A prayer in JSAD’s application was to have 50 per cent of High Court judges appointed from the service quota.

The Delhi High Court, in its counter-affidavit to the application, stated that there is no discrimination when it comes to recommending judges from the national capital’s district courts for elevation.
