Madras High Court upholds conviction in sexual assault case based on 4.5-year-old victim’s testimony

The High Court held that the trial court had relied on the victim’s testimony and other medical evidence while convicting and sentencing Ramki.

It said that there was no reason to disbelieve the testimony of the minor victim girl.

The Court also lamented that such acts of sexual assault and crimes against women were happening at a time when the country has a woman as its President.

“In an era when our President is a woman, we need to hang our heads in shame for such crimes being perpetrated on a daily basis,” the Court said.

Pertinently, the Court pulled up the defence counsel before the trial court for having asked “appalling” and inappropriate questions to the minor victim.

The counsel had asked the minor girl to specify which hand had the convict used to sexually assault her. This question, the High Court said, was “appalling to say the least.”
