RTI: Delhi High Court sets aside CIC order to disclose tax exemptions sought by Ram Mandir trust

While setting aside the CIC directions, Justice Prasad relied on his judgement in the case of CPIO/Dy Commissioner of Income Tax HQ Exemption, New Delhi vs. Girish Mittal.

In this judgement, the High Court had set side a CIC order to provide information under RTI on tax exemptions allowed to the PM Cares Fund.

“In view of the above, the writ petition is allowed. The Impugned Order dated 30.11.2022 passed by the Ld. CIC is set aside. Pending applications, if any, also disposed of However, it is always open for the Respondent to approach the appropriate authority under the Income Tax Act to seek information as sought for in the RTI application,” the Court ordered on February 28, in the case concerning the Ram Mandir trust.

Notably, an appeal has been filed against the Girish Mittal judgement. It is scheduled to be heard next on July 10.
