The Court took note of the issue while dealing with a petition by a transman who wished to update his name, gender and other details in his school records after he underwent sex reassignment surgery.
During the hearing, the Court asked the petitioner’s counsel if there were any guidelines or rules to regulate the process of changing one’s name, gender, etc. after such a surgery.
However, the lawyer was unable to find any such rule or guideline.
Taking note of this, a Bench of Justice Alok Mathur directed the State to submit a report on this aspect by August 20.
“Accordingly, learned Standing Counsel is directed to find out existence of any rule, guideline or Government Order which may provide for change of name, gender and other details of a person who has undergone Gender re-assignment surgery, and place the same before this Court on the next date of listing,” the Court directed.
