Khan was arrested by the Delhi Police on March 13, 2020 and was named in three First Information Reports (FIRs). He has been charged with criminal conspiracy, culpable homicide and other provisions of the Indian Penal Code (IPC) and the Unlawful Activities Prevention Act (UAPA).
The allegation against him is that he is one of the main conspirators of the riots who instigated the crowd and destroyed CCTV footage. While he has been granted bail in two FIRs, his plea for bail in the Delhi Riots larger conspiracy case was rejected by the special court in March.
