Justice Yashwant Varma passed the order in Jain’s plea challenging proceedings against him under the Act stating that these alleged transactions took place between 2011 to March 2016 and, therefore, the amendments to the law which came into effect later on would not apply.
The Act had been amended by way of Benami Transaction (Prohibition) Amendment Act in 2017.
