Delhi High Court passes John Doe order to restrain trademark infringement of Shardul Amarchand Mangaldas

In an order passed on August 7, Justice Mini Pushkarna also restrained the infringers from using the name or image of firm’s Executive Chairman Dr Shardul S Shroff or any of its partners/ members.

John Doe orders are blanket cease and desist injunctions that are issued against anonymous entities. They are usually passed in suits involving infringement of intellectual property rights since it is often practically impossible to track down every infringing party.

The Court ordered Google to block fake email IDs and reveal details such as phone numbers associated with them.

The Central government was ordered to issue orders for blocking of phone numbers.

“The plaintiff [Shardul Amarchand Mangaldas] is granted liberty to publish a Public Notice informing the general public, about the fact of the various false communications being issued by unknown persons, thereby, using and infringing the registered trademark, logo, trade name and names of representatives of the plaintiff firm, and also the fact regarding the filing of the present suit,” the Court said.
