About the Event

At the backdrop of the COVID-19 pandemic and a new era of economic sanctions, third-party funding has received even more attention in international arbitration. It ensures that commercial parties may defend their interests even despite limited funds to finance costly international arbitration proceedings.

At the same time, third-party funding still raises ethical concerns and thus faces legal constraints in various jurisdictions. Even past these considerations, the inclusion of an external funder may affect all stages of arbitration and thus require thoughtful management.

During this lecture, Anastasiya will express her views on the following issues:

  • The notion of third-party funding in arbitration;
  • Dynamics of different jurisdictions’ approaches to the admissibility of third-party funding in arbitration;
  • Mechanics of confidentiality, arbitrators’ neutrality, and costs’ recovery in arbitration in the light of third-party funding.
