Justice MS Sonak of Bombay High Court becomes first person in Goa to register ‘Living Will’

In 2018, the Supreme Court had recognised and given sanction to passive Euthanasia and living will/ advance directive.

The Supreme Court recognized living wills of terminally ill patients who could go into permanent vegetative state and issued guidelines for regulating this procedure.

It laid down guidelines governing execution and enforcement of advance directive, as well as the procedure to be followed for passive Euthanasia in case there is no living will/advance directive.

The guidelines pertained to questions such as who would execute the living will, and the process by which approval could be granted by the medical board. 

The apex court also modified its 2018 judgment to do away with the role of judicial magistrates giving sanction and validity to the living will/ advance directive executed by a person.
