Kerala High Court seeks State’s response on plea for fast-track mechanism to address police misconduct against lawyers

The petition by KHCAA and its President Yeshwanth Shenoy and Secretary Anoop V Nair raised grievance against the continuous police brutality against advocates and the lack of adequate law or protocol to prevent such occurrences.

“Multiple incidents have happened in Kerala in the last few years where the police have harassed, beaten up, tortured, and filed false FIRs against advocates,” stated the plea

The petitioners lamented that even though the High Court had addressed this issue earlier, such illegal acts continues to happen without any respect for the legal system.

The plea referred to a recent incident in which an advocate visited the Alathur Police Station for professional duties and was allegedly harassed and abused by police officers there.

Multiple frivolous and false cases were registered against the said advocate, added the plea.

The petitioners said that advocates find it hard to carry out their duties because of such police atrocities.

“There is a legal vacuum that exists when it comes to laws protecting advocates in their professional functioning,” the plea said.

It also highlighted that no guidelines have been issued by police even after multiple instances of such violence and false first information reports (FIRs) against advocates were reported across the State.

Therefore, the petitioners said that the Court should issue guidelines to be followed for registration of cases against lawyers.
