Somaiya in his plea filed through law firm, Law Counsellors alleged that the details of the FIR were manipulated by the Mumbai police in order to protect the Shiv Sena workers who attacked him.
He, therefore, sought invocation of inherent powers of the Court under Section 482 of the Code of Criminal Procedure to quash the FIR.
As per the petition, Somaiya was brutally attacked by workers of the Shiv Sena while at the Khar Police Station. He then attempted to make a complaint at the Bandra Police Station.
He submitted that on taking the petitioner’s statement in a detailed manner, the Police Inspector lodged a “fake and frivolous” FIR which manipulated the facts.
