The Court was hearing a petition filed by a 15-year-old student who sought enforcement of various health regulations which he claimed were being violated by online platforms.
The teenager, represented by his guardian, approached the Court after being deeply concerned over the high use of smoking and vaping among his peer groups in Chandigarh.
In his plea, he claimed that the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade And Commerce, Production, Supply and Distribution) Act (COTPA), 2003 and the Prohibition of Electronic Cigarettes (Production, Manufacture, Import, Export, Transport, Sale, Distribution, Storage, and Advertisement) Act, 2019 were not being implemented in letter and spirit.
As a result, banned products like e-cigarettes were easily available to teenagers, he claimed.
