Supreme Court imposes ₹10k costs on BJP’s Aminul Haque Laskar for seeking adjournment

The matter arose from the 2021 election of Barbhuiya from Sonai Legislative Assembly constituency. Laskar had lost to him in that election.

Later, on the basis of information obtained under Right to Information Act (RTI Act) he filed an election petition challenging Laskar’s election.

The plea alleged discrepancies in the educational qualification stated in the AIUDF leader’s election affidavit.

As per the plea, Barbhuiya in his affidavit submitted to the Election Commission before the last assembly elections in Assam, had claimed that he graduated from the Choudhury Charan Singh University in Meerut in 2019.

However, the State education board had stated that there was no record of him having passed the class 12 examination.

The Commission still let him contest the polls leading to Laskar moving the High Court in an election petition, Laskar contended in his election petition.

On April 26, the Gauhati High Court rejected an application by Barbhuiya to dismiss the election petition leading to the instant appeal before the apex court.

The Supreme Court had issued notice in the matter in May and stayed proceedings against Barbhuiya.
