Supreme Court stays demolition of Goa’s beach shack Curlies

The plea filed by the shack owner against an order of the National Green Tribuna (NGT) was mentioned on Friday before a bench of Chief Justice of India UU Lalit and Justices S Ravindra Bhat and PS Narasimha for urgent listing and interim relief.

The Court noted that the NGT order directing demolition of the structure for violation of Coastal Regulation Zone guidelines, was passed on September 6 and the demolition was already ongoing.

Further, it noted that the NGT order was limited to structures falling within a particular survey number. It, therefore, issued notice in the matter and granted stay.

“We direct structures in existence in land other than survey no 42.10 are not being covered by this order. Resultantly, if there is unauthorised constructions in lands other than survey 42.10 then demolitions can go on. However there shall be a stay on demolition of structures in land built on 42.10. This is subject to appellants not carrying out any commercial structure,” the Court directed.

It also asked the State of Goa to file its reply by September 14, next Wednesday.

Senior Counsel Huzefa Ahmadi appeared on behalf of the appellant.
