The Court was hearing mentioning matters today when a counsel mentioned an admitted matter that was at the hearing stage.
This prompted the Chief Justice to remark,
“I do not know what is the procedure here, but the appropriate procedure to my mind, if you want to get the hearing matter listed, is to file an application for early hearing. There must be a provision in the [Gauhati High Court] rules.“
The Chief Justice was told by a standing counsel for the High Court that this was not the case for the Gauhati High Court. However, advocates, as a matter of convention, would file petitions for an early hearing in such cases.
Chief Justice Mehta then said that he would look into addressing the issue.
‘We will look into it, because there has to be proper provision whereby an application can be filed for early hearing,” the Chief Justice said.
The Chief Justice then proceeded to ask the counsel who made the mention to file an appropriate application, following which the Court would pass an order.
