Supreme Court seeks response from Central government on plea against shifting detenues from Jammu & Kashmir to jails in other States

The petition filed through advocate Satya Mitra sought directions to various States to send prisoners hailing from J&K but lodged in jails in such States, back to the Union Territory, so that their respective families can remain in touch with them. 

The petitioners, whose family members have been detained under the Act, claimed that they have lost contact with the detenues after they were shifted to jails outside the Union Territory.

The petitioners stated that they were also not provided with details of the jail where the detenues are kept and are, hence, unable to meet them.

It also meant that detenues have not been able to avail proper legal remedies resulting in violation of their fundamental and constitutional rights. 

The petitioners also stated that the Union Territory’s excuse to transfer the detained persons outside the State to avoid congestion of prisons was arbitrary.
