A bench of Acting Chief Justice SV Gangapurwala and Justice Sandeep Marne said that a co-ordinate bench of the High Court had in 2016 refused to grant relief in a PIL filed by the same petitioner seeking similar reliefs.
“Earlier PIL filed by the present petitioner to frame guidelines for safety of the gathering people at Ganpati festivals is rejected by an order of September 2, 2016, and for the same purpose, the second PIL would not be tenable. In view of that order, the present PIL cannot be considered. The PIL as such is dismissed,” the Bench held.
