How can Kolkata Police curtail BJP leader’s constitutional right to hold peaceful demonstration? Calcutta High Court

BJP leader Tushar Kanti Ghosh had moved the High Court challenging the decision of the Police to deny him permission to hold a rally. He also questioned the authority of the police inspector in-charge of the Bhangore Police Station to issue orders under Section 144 of the Code of Criminal Procedure (CrPC), thus preventing the rally from taking place. 

The Police had justified the need to pass prohibitory orders in light of the recent volatile clashes between members of the ruling Trinamool Congress (TMC), the Indian Secular Front (ISF) and the Communist Party of India CPI(M), which took place last month. 

The Bhangore area, which is situated in the heart of Kolkata, witnessed violent clashes as members of these political parties sparred over hoisting their respective party flags. A day later, clashes took place between the Police and the ISF over the arrest of one of the party’s members.
