“Happens in every State”: Delhi High Court on plea against BJD using party symbol in government scheme promos

The plea filed by Odisha BJP General Secretary Jatin Mohanty said that a political party’s symbol cannot be used by the government whereas the Odisha government, while promoting its schemes in the media, was using the conch symbol.

He, therefore, sought directions to restrain the BJD from using its party symbol while advertising such schemes in newspapers, TV channels and other media.

It was argued that using the symbol while promoting government schemes amounts to a violation of paragraph 16-A Election Symbols (Reservation and Allotment) Order as well as Model Code of Conduct for the Guidance of Political Parties and Candidates.
