Karnataka moves Supreme Court challenging quashing of case against JDS leader for damaging EVMs

That appeal was filed by the State challenging a July 2023 order of the Karnataka High Court’s Kalaburagi Bench.

It was contended that the complaint against the accused, a retired police officer (BB Patil) who joined the JD(S), was wrongly quashed.

“(This was) without appreciating that there are overwhelming material against him which was placed on record in the form of video recordings and photographs showing him to be part of the mob that attacked and abused the government officials on election duty and damaged the EVM machines,” it was submitted.

The State in its plea emphasised that the accused had played an active role and led the mob that attacked poll officials, causing damage to vehicles and destroyed election materials including EVMs last year during the assembly polls.

“Video recording which are part of the charge sheet reveal that the respondent was part of the unlawful assembly and led the unlawful assembly and committed the offences,” it was added.

Further, the chargesheet was not part of the proceedings before the High Court, it was pointed out.
