Supreme Court berates legal aid counsel for not giving his “100 percent” to the case

A division bench of Justice Sudhanshu Dhulia and Justice Ahsanuddin Amanullah also took objection of the fact that the advocate was reiterating time and again that it was a ‘legal aid’ matter.

“What is the requirement of saying that this is a legal aid matter? You have the same responsibility like any other case. Argue on merits,” Justice Dhulia remarked.

When the advocate tried to argue for some time, an unimpressed Justice Amanullah said that the advocate was not at all prepared for the case since it was a legal aid matter and he had not “given his 100 percent” to the case.

“I must tell you one thing that you’ve not given you 100 percent in this case. If this would have been any regular case, you would have given. However, in such cases you must give double your efforts. I really don’t like this practice and I have always objected this. These are critical cases and you are not prepared at all,” Justice Amanullah remarked.
