Procedure of Drafting
Drafting may be defined as the synthesis of law and fact in a language form. The goal of the law is to reduce public suffering to the greatest extent possible, to prevent political and social injustices, and to ensure that everyone is treated fairly. At the national level, the parliament makes these laws, while at the state level the state legislature makes them.
Schedule 7 of the Indian Constitution divides power between the central government and state governments. The Union list includes subjects that can only be formulated, changed, and governed by the central government; the state list includes subjects that can only be governed and formulated by the state government; and the concurrent list includes subjects on which both the state and the central government may formulate laws.
Language and Drafting
Legal drafting is a highly in-demand legal skill with proper implementation soft skills. As a legal draftsman, the process of superior writing skills is paramount. The usage of correct English with suitable grammar is the most important component for defining the credibility of a lawyer.
Editing and reviewing would be the most critical skill when drafting a legal notice, a contract, or even a police complaint. Editing is nothing but making sure that your write-up is “making sense the way it should”.
It’s not just about using the right words, cutting out the grammatical and spelling mistakes, tweaking the sentence structure, and even checking the punctuation at the end of a sentence. While those things are important, they are just elementary.
