Justice Anoop Jairam Bhambhani then ordered that while there may be an arbitral dispute between the two sides, the cargo which is supposed to be used for Delhi Metro, cannot be withheld.
“…this court is satisfied that the petitioner has been able to make-out a prima-facie case for issuance of the limited interim direction to respondents Nos.1 and 2, directing them to issue to the petitioner the requisite cargo delivery orders with respect to the cargo comprising 100 packages of components of Tunnel Boring Machine intended for augmentation of Delhi Metro Rail project, under Fixture Note dated 22.04.2022, within 03 days from the date of the receipt of the copy of this order,” the Court ordered.
The Court further said that the reply to the petition be filed in four weeks and listed the case for further hearing on October 31.
