Pathan is accused of several offences including rioting, unlawful assembly hate speech and promoting enmity between different groups.
In December 2021, charges were framed against him and he was denied bail by the trial court in the case on December 14, 2023.
The trial court noted that during proceedings in court, Pathan had passed a note to a co-accused with a phone number. It further noted that in jail, he once went missing, and was also found carrying a mobile phone, engaging in scuffles and arguments with inmates as well as officials.
Based on this, the seriousness of the allegations against him and the fact that a video of him pointing a gun at a cop was on record, the trial court denied bail to Pathan.
This led to the appeal before the High Court.
