Inter-state distance learning ban: UGC moves Supreme Court against Madras High Court order to exempt graduates, enrolled students

The Madras High Court, in its January ruling, had upheld a UGC regulation mandating that state universities – both private and government-funded – can undertake distance learning programme-related activities only within the territorial jurisdiction of their respective states.

The High Court, however, had made it clear that there is no bar on students from outside the State enrolling in such programmes, provided the activities of such universities do not span beyond the State.

It was clarified that deemed universities can continue to conduct online distance education programmes in compliance with the UGC Regulations, and on securing requisite UGC recognition.
