Person seeking appointment as district court employee must have clean antecedents: Allahabad High Court

The appellant had applied for a Group ‘D’ position in response to the advertisement dated October 27, 2022, issued by the High Court Recruitment Cell for the 2020-23 period.

After successfully passing the examination and being selected for the position, the appellant received an appointment letter from the District Judge, Etah, and started work.

Although he had submitted an affidavit at the time of joining stating that he had no pending criminal cases, police verification revealed that a case for offences under the Indian Penal Code (IPC) had been registered against him where he had been acquitted.

Since High Court instructions in the advertisement specified that the discovery of a criminal case against a candidate would result in the cancellation of their appointment, the appellant’s services were terminated.
