The plea was filed in light of a recent incident where a petition was found to have been filed by a non-existing advocate.
The Calcutta High Court had, on finding that a lawyer through whom the petition was filed did not exist at his address given on record, directed the Deputy Inspector General (DIG) of the Crime Investigation Department (CID) to investigate the matter.
Justice Md Nizamuddin, while hearing the case, was informed that the advocate representing the petitioner appeared to have no existence at his address. Additionally, none of the residents in the area knew or had heard of him.
In another petition filed by the same advocate, the petitioner had complained that she never filed such a case nor authorised anyone to file a case on her behalf.
