Arrest by ED illegal; Habeas Corpus plea maintainable: TN Minister V Senthil Balaji to Madras High Court

Elango, however, cited the Supreme Court judgement in Gautam Navlakha’s case to argue that the High Court could use its discretion to admit a Habeas Corpus petition even at the present stage. 

Elango further said that the ED had acted in a malafide manner because even though the minister had been fully cooperating with the probe agency, it arrested him without following due process.

“Till now, the details of what transpired when the minister was in their custody from June 13 to early hours of June 14 has not been provided by ED even to the Court,” Elango said.

The Court will hear the ED’s arguments on June 27.
