Bail order must give specific reasons; reasoning is life blood of judicial system: Supreme Court

The apex court stated that although there is no “straight-jacket formula” to determine the relevant factors which are to be considered before granting of bail, “certain important factors that are always considered, inter­ alia, relate to prima facie involvement of the accused, nature and gravity of the charge, severity of the punishment, and the character, position and standing of the accused“.

In this case, the apex court opined that the High Court had not considered the grievous nature of the offence and the fact that the accused was a habitual offender with over 20 cases registered against him.

Moreover, the Court noted that the order there was no reasoning evident from the High Court’s order.
