“Prima facie, it appears to this court that the Civil Judge (Senior Division), Uluberia, erred in fixing the suit ex-parte without granting opportunity to the defendant to file written statements, although it has been recorded by the court that the plaintiff had not served a copy of the plaint upon the defendant and had not complied with the earlier order,” the Court said in its order.
