The prosecution contended that based on the investigation under Section 120B (criminal conspiracy) of the Indian Penal Code and Sections 13(1)(B) and 13(2) of the Prevention of Corruption Act, 1988, no actionable offence was found against the couple.
The Court noted that a letter by the Superintendent of Police, ACB dated December 4, 2023 ordered the closure of the case based on the recommendation of the legal officer of the Bureau after reviewing the investigation report, as no evidence warranting prosecution was found.
Based on the letter, a decision was made at the Bureau level to close the disproportionate assets case.
