PIL filed before Supreme Court seeking protection for doctors from arbitrary medical negligence cases

The petition was filed in light of death of Dr Archana Sharma of Jaipur who died by suicide on March 29, 2022, after murder charges were pressed against her by Rajasthan Police after the death of a patient.

The plea filed through advocate Shashank Deo Sudhi also sought a probe by the Central Bureau of Investigation (CBI) into the circumstances that led to death of Dr Sharma, a gynecologist.

The petition said that doctors are regularly falling victims of physical assault at the slightest suspicion over treatment and delay recovery of the patients.

The plea, therefore, prayed for a scheme to compensate the loss of lives of such doctors, by giving financial to their families.

Besides, the plea said that police lack training and understanding to deal with medico-legal cases .

“Qualified doctors are being victimizes by the illegal and arbitrary treatment from the State police under the presumption of medical negligence,” the petition stated.

Hence, the plea said that there is an urgent requirement for training of the police officials for such cases, besides specific qualifications enabling the police officer to understand cases of medical negligence.
