In 2014, a single-judge of the Madras High Court had restrained the firm from filing a defamation suit in Singapore against Swamy. In the judgment presently under challenge, passed on April 18 this year, a division bench of Justices SS Sundar and PB Balaji had set aside this injunction order.
The division bench had reasoned that the Court lacked the jurisdiction to grant such an anti-suit injunction against a foreign company. Further, it held that the High Court cannot decide whether or not the Singapore High Court has jurisdiction in the matter.
