A Bench of Justices AS Bopanna and Hima Kohli was told that the Goa Coastal Zone Management Authority (GCZMA), which had initially called for the demolition of Curlies, was not present on the day the order was passed by the NGT.
Thus, the Court found that it would be appropriate “in the interest of justice” to restore the appeal before the NGT so that both parties can furnish their arguments and fresh orders can be passed.
“In that circumstance, we feel that the principles of natural justice would require that an appropriate opportunity be granted to both the parties and then, an appropriate decision be taken by the NGT,” the order stated.
