The petitioner’s counsel argued that the accused was innocent and had been falsely implicated in the case. The accused, a senior citizen aged about 70 years, had no previous criminal history, he added.
It was further argued that there was nothing on record indicating that the applicant was arrested based on the alleged video. The counsel contended that the applicant had been in jail since July 23, 2023, and thus was entitled to be released on bail.
It was also urged that there is no possibility of the applicant of fleeing away after being released on bail or tampering with the witnesses. In case, the applicant is released on bail, he will not misuse the liberty of bail, the counsel assured.
The State counsel opposed the bail plea but could not counter the facts.
In view of the above, the Court granted bail to the accused.
