Lok Sabha Elections: Madras High Court dismisses PIL against BJP candidate’s nomination from Tirunelveli

The petition was filed by one V Maharajan, a resident of Madurai district. Maharajan claimed in his petition that Nagendran’s nomination had been accepted despite the fact that it was in breach of the provisions of Sections 33, 33 A, 34, and 35 of the Representation of the People Act, 1951.

The petitioner said that Nagendran had filed two separate nomination papers for the same constituency, one as a candidate of the Bharatiya Janata Party and the other as an independent candidate. Besides, in both these forms, he had suppressed the fact that there was a criminal case pending against him under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the petitioner said.
